Welcome to https://create.alpha91.co.za (the "Platform"), operated by Alpha91 Enterprises (Pty) Ltd. These Terms of Service ("Terms") govern your use of the Platform and services offered through it. By accessing or using the Platform, you agree to be bound by these Terms.

1. Account Registration

You must be at least 18 years old to register.
All information you provide must be accurate, current, and complete.
You are responsible for maintaining the confidentiality of your login credentials.

2. Acceptable Use

You agree not to misuse the Platform. Prohibited activities include but are not limited to:

Uploading or distributing harmful, illegal, or fraudulent content
Attempting to gain unauthorized access to other accounts or systems
Engaging in abusive or misleading conduct toward users or staff
Using the Platform to violate any laws or third-party rights

3. Fees and Payments

Alpha91 charges a transaction fee of 2.5% per sale.
Payments are processed via trusted third-party gateways such as Ozow.
You are responsible for all applicable taxes, duties, or other charges related to your use of the Platform.

4. Suspension, Termination & Abuse

Alpha91 reserves the right to take immediate action to protect the integrity of the platform, its users, and its operations. This includes suspending or terminating access to the Platform without prior notice if we determine that you have violated these Terms or applicable laws.

Grounds for Suspension or Termination:
- Non-payment for services after 7 days
- Use of fraudulent, stolen, or invalid payment methods
- Suspected abuse, spam, or platform exploitation
- Harassment or verbal abuse toward Alpha91 staff or users
- Hosting illegal, deceptive, or prohibited content
Investigation: Accounts suspected of fraud, abuse, or other violations may be suspended while under review. We reserve the right to share relevant evidence with legal or financial authorities as needed.
Restricted Access: During a suspension, access to shop data, API endpoints, and subdomains may be limited or blocked. Final decisions are at the discretion of Alpha91 management.
Permanent Bans: Severe violations or repeated abuse may result in a permanent ban from the platform with no refund or data recovery entitlement.

5. Refunds and Data Access

Refunds are considered on a case-by-case basis at the discretion of Alpha91 Enterprises.
Suspended or terminated accounts with unpaid invoices may not be eligible for data export or access restoration.
Users are responsible for regularly backing up any critical content uploaded to the Platform.

6. Intellectual Property

All intellectual property related to the Platform, including branding, design, and backend systems, remains the exclusive property of Alpha91 Enterprises (Pty) Ltd.
Users retain ownership of content they upload but grant Alpha91 a non-exclusive license to store, display, and process such content in the course of platform delivery.

7. Service Availability

While we strive to ensure continuous uptime, we do not guarantee uninterrupted service. Scheduled maintenance, system upgrades, or unexpected technical issues may result in temporary service outages.

8. Limitation of Liability

Alpha91 shall not be held liable for indirect, incidental, or consequential damages resulting from the use of or inability to use the Platform. This includes data loss, lost profits, or business interruptions.

9. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes take effect indicates your acceptance of the new terms. The most recent version will always be available on the website.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be resolved in the courts of jurisdiction where Alpha91 Enterprises (Pty) Ltd is registered.
